Application and acceptance
These policies apply to services provided by Axanti, including web hosting, managed VPS, managed dedicated servers, domain names, email, backups, technical support, web development, WordPress/WooCommerce, custom plugins, AI & SEO integration and system administration.
Axanti is operated by Axanti Inc., a Quebec business providing web, hosting, development and managed services. Public contact details are info@axanti.ca and +1 819 820-0788.
By using, ordering or renewing an Axanti service, you accept these policies. A quote, written agreement or specific contract may set additional terms; in that case, those terms supplement these policies or replace them where they are incompatible.
Services must be used only for legal, responsible activities that comply with applicable laws.
Online orders and distance contracts
When a service is ordered online, the offer details, price, taxes, applicable fees, payment terms, duration, renewal, cancellation and refund conditions are presented before the order is confirmed.
The client can review and correct the order before submitting it. Where required by law, Axanti sends a confirmation or copy of the contract within the applicable time limits.
Services sold to businesses may be subject to distinct commercial terms. Mandatory consumer rights remain applicable where provided by law.
Acceptable use
Axanti may refuse, suspend, limit or terminate a service where its use affects security, reputation, infrastructure stability, third-party rights or legal compliance.
The following uses are prohibited, among others:
- Illegal, fraudulent, hateful, defamatory, threatening, obscene material or material infringing third-party rights.
- Copyright infringement, pirated software, cracks, hacks, warez or similar content.
- Spam, phishing, unsolicited bulk email, contact lists obtained without consent or abusive email practices.
- Malware, botnets, unauthorized cryptomining, attacks, port scanning, intrusion attempts or bypassing security measures.
- Script, counter, API or tool services offered to a large number of third parties without prior approval where they may affect resources.
- Activities generating excessive load, degrading other clients' experience or exposing Axanti to complaints, penalties or legal risks.
- Use of AI or automation tools to create, process or distribute unlawful, unauthorized confidential or intellectual-property-infringing content.
Hosting, resources and email
Shared hosting, VPS and dedicated server services must use a reasonable share of available resources according to the selected offer. Abnormal CPU, memory, disk, I/O, bandwidth, process, database or email usage may lead to limits, migration to a suitable offer, additional billing or suspension.
Axanti will make reasonable efforts to notify the client where adjustment is possible. However, where an activity threatens security, stability or service reputation, Axanti may intervene without prior notice.
The client remains responsible for published content, stored data, licences, extensions, themes, scripts, credentials, DNS, domain names and email accounts, except where the agreement explicitly assigns a specific responsibility to Axanti.
Email services must not be used to send spam, bypass sending limits, impersonate others, distribute malware or exploit lists without consent. Deliverability also depends on third parties and cannot be absolutely guaranteed.
Managed services, development and AI
Managed services may include, depending on the offer or agreement, server configuration, SSL certificates, firewall, monitoring, system updates, security hardening, backups, optimization and technical support.
Development, WordPress/WooCommerce, plugin, automation, AI & SEO and system administration work is performed according to the agreed scope. Out-of-scope requests, fixes caused by external changes, third-party extensions, client-provided content or unplanned integrations may be billed separately.
Axanti applies professional practices, but no managed service, backup, monitoring or security measure can guarantee the complete absence of outages, intrusions, data loss, human error, software failure or third-party provider issues.
Backups
Axanti may maintain backup copies depending on the offer or infrastructure used. The client must nevertheless maintain up-to-date backups of important sites, files, databases, email, documents and configurations. Axanti cannot be held responsible for damages resulting from data loss.
Payment, renewal and cancellation
Invoices are payable upon receipt unless otherwise stated. The client is responsible for maintaining a working billing address and monitoring renewal, payment, suspension or service change notices.
- An ordered or activated service remains payable even if it is not used.
- Domain names, registry fees, transaction fees, options, professional services, custom development and completed work are non-refundable unless otherwise agreed in writing.
- The 30-day satisfaction guarantee, when offered, applies only to eligible annual hosting plans during the first year and excludes non-refundable fees.
- Fees may apply for rejected cheques or payments, expired domain names, restorations, emergency interventions, late payments or service reactivation.
- Late payment may result in fees, suspension of one or more services on the client account, then termination or data deletion after reasonable notices.
Domain names must be renewed on time. Even where automatic renewals or reminders are in place, the client remains responsible for verifying that essential domain names are active and properly renewed.
Axanti complies with applicable requirements for commercial electronic communications, including sender identification and an unsubscribe mechanism where required. Communications required to perform or administer a service may continue to be sent.
Responsibilities and limits
Axanti is not responsible for indirect losses, revenue loss, traffic loss, business interruption, data loss, email loss, reputation damage, replacement costs, configuration errors made by the client, domain name expiration, third-party provider failure or temporary service unavailability.
The client agrees to indemnify Axanti for any claim, complaint, damage, cost or liability arising from their content, users, data, technical choices, access credentials, non-compliance with these policies or abusive use of the service.
Axanti may cooperate with competent authorities where an activity appears to violate the law or compromise infrastructure security.
Governing law and jurisdiction
These policies are governed by the applicable laws of the province of Quebec and the applicable federal laws of Canada.
Subject to mandatory consumer rights, any dispute will be submitted to the competent courts of Quebec, Canada.
Complaints, references and policy changes
Any complaint or abuse observed on a service hosted or managed by Axanti should be reported to abus@axanti.ca.
Unless the client requests otherwise in writing or a confidentiality agreement applies, Axanti may mention a public website address or client name as a commercial reference where appropriate.
Axanti may update these policies to reflect changes to its services, providers, legal obligations or security practices. The version published on the site replaces previous versions.
